Dancerace LMS: Fair Use and Privacy Notice  

 

Effective: May 1, 2023 

Dancerace PLC (Dancerace) operates an online Learning Management System (LMS) providing invited users with information related to Dancerace applications and ‘Services’. The LMS is designed to build an understanding of the various aspects of the applications and services and to improve general awareness around capabilities, best practices and general use. 

Fair Use Statement 

By using the LMS: 

Users agree to act in a manner that is consistent with its intended purpose and in compliance with all applicable laws and regulations and to not engage in any activity that may infringe upon the intellectual property rights of Dancerace, or use the software application in any way that may cause harm to Dancerace. 

Users agree not to provide access to the software system to anyone without a legitimate business interest. Users shall take all necessary precautions to protect the security and confidentiality of the software system, including but not limited to maintaining strong passwords, securing physical access to any hardware used to access the software system, and not sharing login credentials with any unauthorized individuals. Users shall immediately notify Dancerace of any unauthorized access to the LMS. 

Users acknowledge that the LMS is provided "as is" and without warranty of any kind, and that Dancerace shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the LMS. 

Users accept that Dancerace reserves the right to terminate the LMS at any time and for any reason, and users agree to immediately cease using the software application upon such termination. 

Users accept that the content of the LMS is correct at the point of publishing and that if inaccuracies are found, these should be reported to Dancerace, who will review the inaccuracy for improving its services.  

Users acknowledge that Dancerace will use reasonable endeavours to maintain accuracy within the LMS but does not make any representations or warranties as to the accuracy, completeness, reliability, or suitability of the information or materials contained in the LMS. Users agree to exercise their best judgment and prudence while using the LMS and not rely solely on the contents of the LMS. 

User Data & GDPR 

The information that users entrust to Dancerace is the minimum required to provide users access to the LMS. 

This Statement describes how Dancerace obtain, use, and process user information, by accessing and using our LMS users acknowledge and confirm that they have read this Statement. 

Dancerace offers Services to users in a multiple countries and territories where the laws and customs differ. This Statement provides a general overview of our privacy practices.  

3. LMS Users 

Are exclusively employees or agents of Dancerace customers governed by Dancerace’s Master Services Agreement or SAAS Agreement, and any prospective customers as well as those under non-disclosure Agreements.  

4. Information Collected and Use 

Access to the LMS requires a username and email address.  

The username will be visible to other users and if users wish to remain anonymous, please use an abbreviation or an identifiable pseudonym.  

5. Information Sharing 

Dancerace does not share user information with any other party. 

6. Information Security 

Dancerace has implemented appropriate administrative, technical, and physical security procedures to help protect user information. Dancerace only authorise specific personnel to access personal information and they may do so only for permitted business functions.  

7. Information Deletion and Retention 

Dancerace will retain copies of user information for as long as users maintain an account or as necessary in connection with the purposes set out in this Statement, unless applicable law requires a longer retention period. In addition, Dancerace may retain user details for the duration of any period necessary to establish, exercise, or defend any legal rights. 

8. Information from Cookies 

Dancerace wants user access to the Services to be as easy, efficient, and as useful as possible. To help achieve this, Dancerace uses cookies and similar technologies to improve the user experience and to enhance security. 

9. Information on Statement Changes  

Dancerace may update this Statement in the future with any material and will let users know by doing one or more of the following:  

a) Sending users a communication about the changes, and/or 

b) Placing a notice on the LMS.

If users have a data privacy request, or a general enquiry, such as a request to delete or access user data, users should email support@dancerace.com. 

11. Europe and the UK- General Data Protection Regulation Privacy Statement (“GDPR Statement”) 

This GDPR Statement applies to persons in the European Economic Area (“EEA”), including those based in the United Kingdom. This GDPR Statement supplements our Statement; however, where the Statement conflicts with the GDPR Statement, the GDPR Statement will prevail as to persons located in the EEA. 

11. Australia – Privacy Act 1998 

The Services comply with Australian Privacy Principles and the handling of Personal Information.

13. Rest of World

‘Rest of World’ means all other countries and territories other than those stated in 9, 11 and 12 above. 

GDPR principles will be applied. 

14. Controller of Personal Information  

 Dancerace is the controller of personal information collected in accordance with applicable data privacy laws. 

15. Information Rights Under GDPR 

Users have certain rights regarding user personal information. 

16. Information Uses and Legal Basis 

We will only use personal information under the circumstances permitted by the law or the users. 

17. International Transfers 

The LMS system is a web access application. User personal information is stored in the UK, but access will be unrestricted to the internet.  

18. LearnUpon 

The LMS hosting service is provided to Dancerace and its users by LearnUpon, an ISO 27001 company. Please see their Security Statement or their Data Processing Statement for more:
